THE THE PRINCIPLE OF THE INDEPENDENCE OF THE JUDICIARY AND THE PROBLEMS OF ITS APPLICATION IN PALESTINE IN THE LIGHT OF ISLAMIC LAW

Abstract

The role of the judiciary is to adjudicate cases and resolve disputes. To achieve this, judges must be independent, impartial, and free from any external influence or authority. The Palestinian legislator has explicitly enshrined the principle of judicial independence in the Palestinian Basic Law and other legislation related to the judiciary. However, several challenges hinder the optimal application of the principle of judicial independence. This paper aims to elucidate these challenges and propose solutions by employing an inductive and analytical approach, considering Islamic jurisprudence's stance on judicial independence. This paper concludes that Islamic jurisprudence predates modern legal systems in emphasising the principle of judicial independence and providing safeguards for its enforcement. Additionally, legal provisions of judicial independence often contain ambiguities and lack clarity, especially concerning the regulation of the relationship between the judiciary and other authorities. The paper recommends the full implementation of the principle of judicial independence and the removal of any conflicting elements within the Palestinian judicial system. Such measures would have a significant impact on achieving justice.
