Abstract

Hisba is a religious position that aims at reforming societies and preserving them from delinquency. It is one of the origins of religion, which is the promotion of virtue and the prohibition of evil. He is the one who takes over the task of religious reform, like the prophets and messengers of Allah, prayers and peace be upon them all. He looks at the conditions of people, takes care of their affairs and interests, supervises trade and markets, prevents transactions and prohibited sales like riba, and combats and terminates vices. He is interested in correcting all what he sees as imbalance in the affairs of religion and the world, and these tasks show the important role of al-muhtasib in supervising the proper functioning of society, ordering the favor if it is abandoned and forbidding evil if it appears to be done, and considers whatever it deems in the interest of Muslims and takes care of all the solemn and despicable things. Therefore, al-muhtasib must have conditions and ethics that have an impact on his personality to help him in the success of his reform mission and the application of the powers granted to him, which is known as al-ihtisab levels in order consider whatever he deems to be of interest to Muslims in all fields, whether it relates to the rights of Allah or the rights of slaves or common rights between them. Finally: the research included the role of al-muhtasib in the present era, and that what he was doing in the past time has been assigned in the present era to several ministries because of the development and breadth of the country.

الحسبة من الولايات الدينية التي تهدف إلى إصلاح المجتمعات وصيانتها من الانحراف، وهي أصل من أصول الدين وهو الأمر بالمعروف والنهي عن المنكر. والمحتسب هو من يتولى مهمة الإصلاح الدينية أسوة بأنبياء الله ورسله صلوات ربي وسلامه عليهم أجمعين، فهو ينظر في أحوال الرعية والكشف عن أمورهم ومصالحهم، والإشراف على التجارة والأسواق، ومنع المعاملات والبيوع المحرمة كالربا، ومحاربة الرذائل وإخمادها، فهو يهتم بتصويب كل ما يراه من خلل في أمور الدين والدنيا، وهذه المهام تبين ما للمحتسب من دور مهم وأساس في الإشراف على حسن سير المجتمع، يأمر بالمعروف إذا ظهر تركه وينهى عن المنكر إذا ظهر فعله، ويحتسب في كل ما يراه مصلحة للمسلمين وينظر في جميع الأمور الجليلة والحقيرة. لذلك لابد أن تتوافر في المحتسب شروط وآداب يكون لها أثرا على شخصيته لتساعده في نجاح مهمته الإصلاحية وممارسة الصلاحيات الممنوحة له والتي تعرف بمراتب الاحتساب حتى يحتسب في كل ما يراه مصلحة للمسلمين في جميع المجالات سواء أكان ذلك يتعلق بحقوق الله أم بحقوق العباد أم بالحقوق المشتركة بينهما. اشتمل البحث على دور المحتسب في العصر الحاضر، وأن ما كان يقوم به في الزمن الماضي أسند في العصر الحاضر إلى عدة وزارات بسبب التطور واتساع البلاد.
