The Equality In Women’s Right Between Islamic Jurisprudence And Feminist Organizations In Bangladesh: An Analytical And Evaluative Study

المساواة في حق المرأة بين الفقه الإسلامي والمنظمات النسويّة في بنغلاديش: دراسة تحليلية تقويمية

Abstract

This article discusses viewpoints of feminist organizations in Bangladesh around equality of women. The central issues of the study relate to the concepts of equality between man and woman. Following the inductive, analytical and comparative methods, researchers discusses these concepts in the light of what is available in Islamic Jurisprudence and what is maintained and demanded by feminist organizations in Bangladesh. Then, they conducts a comparative study between them.  The result of the study reveals the fundamental differences between Islamic Jurisprudence and the feminist organizations of Bangladesh regarding the concepts of woman’s rights and her equality with man. The study also explains the necessity of appropriate understanding of the term “woman’s rights”, this research finds that both Islamic Jurisprudence and feminist organizations in Bangladesh emphasize on providing woman’s rights, but Islamic Jurisprudence is the most suitable, appropriate and useful mechanism for achieving women’s rights.

يناقش هذا المقال رؤية المنظمات النسوية في بنغلاديش حول المساواة في حق المرأة، دراسة تحليلية بينها وبين الفقه الإسلامي في حق المرأة بالمساواة بينها وبين الرجل، ويركز في مفاهيم حقوق المرأة بالمساواة بين الرجل والمرأة، حيث يناقش الباحثان هذه الرؤية في ضوء ما جاء في الفقه الإسلامي من ناحية، وما تدعيه وتطالب به المنظمات النسوية في بنغلاديش من ناحية أخرى، ثم يقومان بالمقارنة بينهما والنقد ما تطالب به المنظمات النسوية في بنغلاديش، متبعا في ذلك المنهج الاستقرائي والتحليلي النقدي. ومن أهم النتائج التي توصل إليها الباحثان من خلال هذا المقال: بيان الفروق الجوهرية بين المنظمات النسوية في بنغلاديش والفقه الإسلامي في مفهوم المساواة بينها وبين الرجل، كما توصل البحث إلى التأكيد على إعطاء حقوق المرأة وعدم ظلمها في الشريعة الإسلامية وكذلك في المنظمات النسوية في بنغلاديش، مبينا أن الفقه الإسلامي عدل المرأة وأنه أصلح وأنفع نظام للحصول على حقوقها.
