The Concept Of Mukhalafa According To Imam Al-Salmi And Its Applications Through The Book Of Purity

مفهوم المخالفة عند الإمام السالمي وتطبيقاته من خلال كتاب الطهارة

Abstract

This research aims to explain the concept of dissent according to Imam Al-Salmi from his book Tal‘at al-Shams and its applications from his explanation of the Musnad of Imam Al-Rabi'—may God Almighty have mercy on them. The problem of the research lies in determining the meaning of the concept of dissent according to al-Salmi and explaining its jurisprudential applications to this concept through the issues of purity, which Imam al-Salmi indicated as evidence of the concept of dissent in the first book and the book of purity from his book “Explanation of al-Jami’ al-Sahih.” The research came to answer the following two questions: What is the concept of violation according to al-Salmi, and what is its validity? What are the jurisprudential applications in which the Imam relied on the concept of dissent in explaining his ruling? In this research, we followed an inductive and descriptive approach. We arrived at results, perhaps the most important of which are: Imam al-Salmi invokes the concept of dissent other than the concept of title; because adopting it leads to error, and we came across six applications in the chapter on purity from his book Sharh al-Jami’, in three of which he worked with the concept of dissent, and in one of them he did not work with it, and he left out declaring in his work the concept of dissent in two of them.

يهدف البحث إلى بيان مفهوم المخالفة عند الإمام السالمي من كتابه طلعة الشمس، وتطبيقاته من شرحه على مسند الإمام الربيع -رحمهما الله تعالى-. وتكمن مشكلة البحث في الوقوف على معنى مفهوم المخالفة عند السالمي، وبيان تطبيقاته الفقهية على هذا المفهوم من خلال  مسائل الطهارة والتي أشار إليها الإمام السالمي بأن دليلها مفهوم المخالفة في الكتاب الأول وكتاب الطهارة من كتابه "شرح الجامع الصحيح"، فجاء البحث ليجيب على السؤالين الآتيين: ما مفهوم المخالفة عند السالمي، وما حجيته؟ وما التطبيقات الفقهية التي اعتمد فيها الإمام على مفهوم المخالفة في بيان حكمها؟ ولقد سلكنا في هذا البحث المنهج الاستقرائي الوصفي، وتوصلنا إلى نتائج لعل من أهمها: يحتج الإمام السالمي بمفهوم المخالفة عدا مفهوم اللقب؛ لأن الأخذ به يفضي إلى الخطأ، وقد وقفنا على ست تطبيقات في باب الطهارة من كتابه شرح الجامع عمل في ثلاثة منها بمفهوم المخالفة، ولم يعمل في واحدة منها به، وترك التصريح في عمله بمفهوم المخالفة في اثنتين منها.
